GOT2SHIP LLC TERMS OF SERVICE

THIS AGREEMENT CONTAINS IMPORTANT LIMITATIONS OF LIABILITY, CLAIM DEADLINES, STORAGE AND ABANDONMENT PROVISIONS, AND A BINDING ARBITRATION AGREEMENT. PLEASE READ THESE TERMS CAREFULLY.

These Terms of Service (“Terms” or “Agreement”) govern the use of services provided by Got2Ship LLC (“Got2Ship,” “we,” “us,” or “our”).

By creating an account, purchasing a subscription, directing packages to a Got2Ship address, submitting a shipment request, or otherwise using Got2Ship services, the customer (“Customer,” “you,” or “your”) agrees to these Terms.

Got2Ship provides package receiving, storage, consolidation, repacking, forwarding, grading-submission assistance, fulfillment, and related logistics services.

Got2Ship is not a shipping carrier, insurer, seller, manufacturer, grading company, authentication company, or customs authority.

1. Accounts & Authorized Use

Customers must be at least 18 years old and must provide accurate and current account information.

You are responsible for:

  • Maintaining accurate contact and billing information;

  • Keeping your login credentials secure;

  • Ensuring packages contain your correct Got2Ship Customer ID or other assigned identifier; and 

  • Activity conducted through your account.

Got2Ship may request identification, proof of purchase, proof of address, ownership documentation, or other information reasonably necessary for security, fraud prevention, shipping, customs, or regulatory purposes.

Account Sharing

Got2Ship accounts and subscriptions may not be shared unless the arrangement has been discussed with and expressly approved by Got2Ship before signup. Without prior approval, you may not allow another person to regularly use your:

  • Account;

  • Subscription;

  • Customer ID;

  • Suite, locker, or mailbox number;

  • Receiving address; or

  • Subscription benefits.

You may not use one subscription for multiple unrelated individuals in order to avoid separate subscription or service fees.

Got2Ship may approve family, business, commercial, or multi-user arrangements before signup and may impose additional conditions.

Unauthorized account sharing may result in additional fees, account restrictions, suspension, or termination.

2. Receiving, Tracking & Handling Packages

Customers are responsible for monitoring purchases and incoming shipments sent to Got2Ship.

Got2Ship is not responsible for determining whether a seller actually shipped an item or for tracking property that has not physically entered Got2Ship's possession.

A carrier tracking status showing “delivered” does not, by itself, establish that Got2Ship received the package.

A package is considered received by Got2Ship only after it has:

  1. Physically entered Got2Ship's custody; and

  2. Been reasonably identified and entered into Got2Ship's receiving or inventory system.

Got2Ship is not responsible for packages that are:

  • Misdelivered by a carrier;

  • Delivered to an incorrect address;

  • Lost or stolen before entering our possession;

  • Delivered without sufficient Customer identification; or

  • Otherwise never physically received by Got2Ship.

  • By sending property to Got2Ship, you authorize us to reasonably:

  • Accept and sign for packages;

  • Open external packaging where necessary;

  • Inspect contents;

  • Photograph property;

  • Measure and weigh shipments;

  • Repackage or consolidate items;

  • Remove packaging;

  • Prepare shipping documentation;

  • Prepare customs documentation using information supplied by you; and

  • Transfer property to carriers or other requested service providers.

Got2Ship is not required to inspect the contents of every incoming package.

Unless a specific service provides otherwise, photographs and inventory records are for identification purposes and are not condition reports, appraisals, authenticity checks, grading opinions, or confirmation of internal quantity or completeness.

You represent that you own property sent to Got2Ship or have legal authority to control and ship that property.

3. Prohibited Items, Customs & International Shipping

Customers may not use Got2Ship to receive, store, or ship illegal, dangerous, restricted, stolen, counterfeit, or otherwise prohibited property.

This includes property prohibited by:

  • Federal, state, or local law;

  • Customs regulations;

  • Export-control laws;

  • Economic sanctions;

  • Destination-country laws;

  • Carrier rules; or

  • Got2Ship policies.

Got2Ship may refuse, hold, return, surrender to authorities, or lawfully dispose of prohibited property and may suspend or terminate the associated account.

The Customer is responsible for costs resulting from prohibited or restricted property being sent to Got2Ship.

Customs Declarations

The Customer is solely responsible for determining and providing the proper customs description and value of their property.

Got2Ship prepares customs documentation based on information supplied by the Customer.

Got2Ship does not:

  • Assign customs values;

  • Determine customs values;

  • Estimate customs values;

  • Recommend declared values;

  • Provide product valuations; or

  • Knowingly falsify, undervalue, or misdescribe merchandise.

Customers are responsible for providing truthful, accurate, and lawful customs information. The Customer or recipient is responsible for all applicable:

  • Duties;

  • Taxes;

  • VAT;

  • GST;

  • Tariffs;

  • Brokerage charges;

  • Import fees; and

  • Government assessments.

Got2Ship is not responsible for customs delays, inspections, seizures, penalties, or charges caused by government action or inaccurate Customer information.

4. Shipping, Consolidation & Carrier Responsibility

Got2Ship arranges transportation through independent third-party carriers. Once a package has been accepted by a carrier, transportation is generally governed by that carriers:

  • Terms;

  • Liability limits;

  • Service rules;

  • Insurance or declared-value rules; and

  • Claims procedures.

Carrier transit times and delivery dates are estimates unless expressly guaranteed by the carrier. Got2Ship does not guarantee carrier performance. Customers remain responsible for legitimate carrier adjustments involving:

  • Actual weight;

  • Dimensional weight;

  • Dimensions;

  • Destination;

  • Service level;

  • Fuel surcharges;

  • Residential or remote-area charges; or

  • Other carrier assessments. 

Consolidation and Repacking 

When you request consolidation or repacking, you authorize Got2Ship to open packages, remove packaging, reposition items, combine shipments, and use replacement packaging. Original packaging that has been removed or discarded may not be recoverable. Got2Ship uses commercially reasonable packaging methods but cannot guarantee that fragile, high-value, collectible, or condition-sensitive property will never be damaged.

5. Collectibles, Grading & Third-Party Services

Customers acknowledge that collectibles can lose substantial value because of relatively minor changes in condition. This may include:

  • Trading cards;

  • Graded cards;

  • Sports memorabilia;

  • Comics;

  • Coins;

  • Autographs;

  • Sealed products; and

  • Other collectibles.

Unless Got2Ship expressly agrees otherwise in writing, Got2Ship does not guarantee:

  • Grade;

  • Surface condition;

  • Corners;

  • Edges;

  • Packaging condition;

  • Seal integrity;

  • Authentication;

  • Market value;

  • Resale value; or

  • Future appreciation.

Got2Ship is not an appraisal, grading, or authentication service. Where Got2Ship assists with submissions to PSA, SGC, Beckett, another grading or authentication company, marketplace, consignee, or other third party, that third party's terms apply. Got2Ship does not guarantee third-party:

  • Grades;

  • Authentication results;

  • Turnaround times;

  • Decisions;

  • Fees; or

  • Performance.

6. Subscriptions, Billing & Payments

Some Got2Ship services require a recurring subscription. By purchasing a recurring subscription, you authorize Got2Ship or its payment processor to charge the applicable recurring fee until cancelled. Cancellation prevents future renewals but does not eliminate amounts already owed. Customers remain responsible for legitimate charges including:

  • Subscription fees;

  • Shipping;

  • Storage;

  • Packaging;

  • Handling;

  • Carrier adjustments;

  • Grading or third-party services; and

  • Other authorized services.

Got2Ship may place shipments or services on hold while an account has an unpaid balance. Completed services are generally non-refundable unless:

  • A billing error occurred;

  • Got2Ship agrees otherwise; or

  • Applicable law requires otherwise.

Chargebacks

Nothing prevents a Customer from lawfully disputing an unauthorized or incorrect payment. However, knowingly submitting a false, fraudulent, or bad-faith chargeback constitutes a material breach of these Terms. Got2Ship may suspend account activity and place property on administrative hold while a payment dispute is investigated. A chargeback does not eliminate legitimate amounts owed.

7. Storage, Nonpayment & Abandoned Property

Got2Ship is not an indefinite-storage service.

Customers are responsible for:

  • Monitoring their account;

  • Maintaining contact with Got2Ship;

  • Paying amounts due; and

  • Providing timely shipping or removal instructions.​

45-Day Rule

If an account becomes unpaid or delinquent, or the Customer stops maintaining meaningful contact with Got2Ship, property remaining in our possession for 45 consecutive calendar days may enter the abandoned-property process. The 45-day period may begin from the later of:

  1. The date payment became due;

  2. The date Got2Ship requested shipping or removal instructions; or

  3. The date meaningful Customer communication ceased.

   After the 45-day period and completion of any additional notice, lien, sale, or other procedure required by applicable law, property may be     deemed abandoned.

To the fullest extent legally permitted, abandoned property may:

  • Become property of Got2Ship LLC;

  • Be sold;

  • Be auctioned;

  • Be donated;

  • Be given away;

  • Be recycled;

  • Be destroyed;

  • Be discarded;

  • Be transferred; or

  • Otherwise be lawfully disposed of.

  • Got2Ship may apply proceeds from a lawful sale toward unpaid:

  • Storage;

  • Shipping;

  • Subscription fees;

  • Handling;

  • Administrative costs;

  • Costs of sale or disposal; and

  • Other legitimate amounts owed.

Any remaining proceeds will be handled as required by law.

Abandonment of property does not automatically cancel outstanding amounts owed to Got2Ship.

Right to Hold Property

To the fullest extent permitted by law, Got2Ship claims any possessory, warehouse, or other lien legally available against Customer property for charges associated with the property or account. Got2Ship may hold property while legitimate amounts remain unpaid.

8. Automatic or Protective Shipment Requests

If continued storage is likely to become financially unreasonable compared with the estimated cost of shipping the Customer's property, Got2Ship may create a proposed shipment or contact the Customer requesting shipment instructions. Got2Ship may also require property to be removed or shipped when:

  • Storage capacity is limited;

  • A subscription ends;

  • An account is terminated;

  • Excessive storage has accumulated; or

  • Continued storage presents an operational or security concern.

  • Creating a shipment request does not automatically authorize Got2Ship to charge or dispatch the shipment unless the Customer has separately authorized such action or applicable account terms permit it.

9. Got2Ship Maximum Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOT2SHIP LLC'S TOTAL LIABILITY FOR LOSS OF, DAMAGE TO, DESTRUCTION OF, MISDELIVERY OF, OR FAILURE TO RETURN CUSTOMER PROPERTY WHILE THAT PROPERTY IS IN GOT2SHIP'S POSSESSION, CUSTODY, OR CONTROL IS LIMITED TO THE LESSER OF:

  • THE CUSTOMER'S DOCUMENTED ACTUAL DIRECT LOSS; OR

  • $200 USD PER PACKAGE OR INCIDENT.

The $200 maximum applies to the entire package or incident, not each individual item.

For example, if a single package contains 50 collectible cards, Got2Ship's maximum contractual liability relating to that package is $200 total, not $200 per card. Declaring or entering an item value for customs, inventory, grading, shipping, authentication, or another administrative purpose does not increase Got2Ship's liability.

A Customer sending property worth more than $200 acknowledges and accepts this limitation unless Got2Ship expressly agrees in writing to a different limit or separate shipment protection applies.

Customers must provide reasonable evidence of:

Ownership;

Got2Ship's receipt of the property;

The alleged loss or damage;

That the loss occurred while the property was in Got2Ship custody; and

Actual financial value.

Excluded Damages

To the maximum extent permitted by law, Got2Ship is not responsible for:

  • Lost profits;

  • Lost sales;

  • Missed auctions;

  • Missed events;

  • Lost grading opportunities;

  • Business losses;

  • Changes in collectible value;

  • Future appreciation;

  • Sentimental value;

  • Indirect damages;

  • Consequential damages;

  • Incidental damages;

  • Special damages; or

  • Punitive damages.

  • Got2Ship is also not responsible for loss, damage, or delay caused by:

  • Carrier mishandling;

  • Seller packaging;

  • Pre-existing damage;

  • Hidden damage;

  • Seller fraud;

  • Counterfeit property;

  • Customs actions;

  • Incorrect Customer instructions;

  • Severe weather;

  • Natural disasters;

  • Government actions; or

  • Other circumstances outside Got2Ship's reasonable control.

  • Nothing in these Terms limits liability that applicable law does not permit Got2Ship to limit.

10. Insurance, Shipment Protection & Claims

Optional insurance, carrier-declared-value coverage, or shipment protection may be available. Coverage must generally be selected or purchased before the applicable shipment. The existence of insurance or shipment protection does not guarantee approval of a claim.

Carrier-related claims remain subject to carrier rules and deadlines.

Outbound Claims

Claims involving missing contents, packaging discrepancies, or visible damage to a shipment delivered to the Customer must be reported to Got2Ship within 48 hours of confirmed delivery.

The Customer should preserve:

  • The shipping box;

  • All packaging materials;

  • Damaged property;

  • Shipping labels; and

  • Other relevant evidence.

  • Got2Ship may require:

  • Photographs;

  • Tracking information;

  • Purchase records;

  • Proof of ownership;

  • Proof of value; and

  • Other reasonable documentation.

Failure to provide timely notice or preserve necessary evidence may result in denial of the claim where the delay materially prevents Got2Ship, the carrier, or the protection provider from properly investigating the loss and to the extent permitted by law.

Inbound Claims Issues involving property already logged as received by Got2Ship including an alleged receiving discrepancy, handling issue, or condition issue—must be reported within 10 calendar days after the package is logged into the Customer's account.

Got2Ship is not responsible for damage occurring before property reaches our facility.

Claims submitted after the 10-day period may be denied where Got2Ship can no longer reasonably investigate the alleged issue.

11. Claims Conduct, Fraud & Settlements

Customers must reasonably cooperate with a claim investigation. Got2Ship may deny claims involving material fraud or intentional misrepresentation, including:

  • False statements;

  • Altered receipts;

  • Fabricated evidence;

  • False ownership claims;

  • Intentionally inflated values;

  • Manipulation or destruction of evidence; or

  • Claims for property Got2Ship never received.

Suspected criminal fraud may be reported to appropriate authorities.

Reviews, Social Media & Public Statements

Customers remain free to provide honest reviews, opinions, criticism, and social-media commentary regarding Got2Ship. An honest negative review or social-media post does not, by itself, void a valid claim.

However, nothing in these Terms protects:

  • Fraud;

  • Knowingly false statements of fact;

  • Fabricated evidence;

  • Threats;

  • Harassment;

  • Extortion;

  • Impersonation;

  • Doxxing;

  • Destruction of evidence; or

  • Deliberate interference with a carrier, insurer, law-enforcement, or claims investigation. If such conduct materially interferes with Got2Ship's ability to investigate a claim, it may affect or result in denial of the claim to the extent permitted by law.

Got2Ship may independently suspend or terminate an account because of threats, fraud, harassment, or serious misconduct even if a separate legitimate claim remains pending.

Settlements and Releases

Where Got2Ship agrees to provide a payment, reimbursement, credit, replacement, or other negotiated settlement, Got2Ship may require the Customer to execute a separate Settlement and Release Agreement before payment is issued.

That agreement may provide that:

  • The settlement fully and finally resolves the specific incident;

  • The Customer releases additional claims arising from that incident, except rights that cannot legally be waived;

  • The payment does not constitute an admission of fault or liability by Got2Ship; and

  • Separately negotiated confidentiality or non-disparagement obligations may apply to the extent permitted by law.

12. Customer Conduct, Suspension & Termination

Customers must use Got2Ship lawfully and reasonably. Got2Ship may immediately suspend, restrict, or terminate an account for reasons including:

  • Fraud or suspected fraud;

  • Nonpayment;

  • Unauthorized account sharing;

  • Prohibited property;

  • Illegal activity;

  • False account information;

  • Fraudulent chargebacks;

  • Credible threats;

  • Harassment;

  • Extortion;

  • Repeated abusive conduct;

  • Security concerns;

  • Regulatory concerns; or

  • Material or repeated violations of these Terms.

  • Where an account is terminated, Got2Ship may require remaining property to be:

  • Shipped after all legitimate charges are paid;

  • Picked up by the registered Customer with acceptable identification where permitted;

  • Returned where reasonably possible; or

  • Otherwise handled in accordance with these Terms and applicable law.

Got2Ship may refuse future service where legally permitted. Termination does not eliminate legitimate outstanding balances.

13. Indemnification

To the fullest extent permitted by law, the Customer agrees to indemnify, defend, and hold harmless Got2Ship LLC and its members, managers, employees, contractors, and agents from third-party claims, penalties, fines, losses, or reasonable legal expenses arising from:

  • The Customer's violation of law;

  • Prohibited property;

  • False customs information;

  • Import or export violations attributable to the Customer;

  • Fraud or misrepresentation;

  • Intellectual-property violations;

  • Property the Customer did not legally own or control;

  • Customer shipping instructions; or

  • A material violation of these Terms.

  • This obligation does not apply to liability that applicable law prohibits Got2Ship from transferring to the Customer.

14. Privacy, Communications & Changes

Use of Got2Ship is subject to our Privacy Policy.

Customers agree that Got2Ship may provide operational, billing, account, shipping, and legal notices electronically were permitted by law.

Customers are responsible for maintaining accurate contact information.

Got2Ship may modify its:

  • Services;

  • Subscription plans;

  • Pricing;

  • Storage allowances;

  • Shipping options;

  • Policies; and

  • These Terms

  • from time to time.

Where required by law, Got2Ship will provide appropriate notice of material changes.

15. Governing Law & Dispute Resolution

Except where mandatory law requires otherwise, these Terms are governed by the laws of the State of South Carolina and applicable United States federal law.

Before initiating formal legal proceedings, Got2Ship and the Customer agree to make a good faith attempt to resolve the dispute directly for at least 30 days.

Arbitration

Except for eligible small claims matters or claims that applicable law does not permit to be arbitrated, disputes arising from these Terms, Got2Ship services, accounts, billing, shipments, property, storage, or claims shall be resolved by binding individual arbitration.

The Federal Arbitration Act governs this arbitration provision to the extent applicable.

Arbitration will be administered by a nationally recognized arbitration provider under its applicable rules.

Class-Action Waiver

To the maximum extent permitted by law, Got2Ship and the Customer agree that disputes must be brought individually and not as a class, collective, or representative action.

Jury-Trial Waiver

To the maximum extent permitted by law, each party waives the right to a jury trial for disputes covered by the arbitration agreement.

Arbitration Opt-Out

A Customer may opt out of arbitration by providing written notice to Got2Ship within 30 days after first accepting these Terms.

The notice must identify the Customer and clearly state the Customer's intention to opt out of arbitration.

16. General Legal Terms

Got2Ship is not responsible for delays or failures caused by events beyond its reasonable control, including severe weather, natural disasters, fire, war, civil unrest, government action, carrier interruptions, utility outages, cyberattacks, or major telecommunications failures. If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions remain effective. Got2Ship's failure to enforce a provision on one occasion does not waive its right to enforce that provision later. These Terms, together with Got2Ship's Privacy Policy and applicable service-specific policies, constitute the agreement between Got2Ship and the Customer. A separately negotiated written agreement may modify these Terms for approved:

  • Shared accounts;

  • Business accounts;

  • Commercial Customers;

  • High-volume Customers;

  • High-value property; or

  • Customized service arrangements.

Informal statements contained in advertisements, social-media posts, FAQs, or ordinary customer-service communications do not modify these Terms unless expressly agreed by Got2Ship in writing.

17. Contact & Acceptance

Questions concerning these Terms, accounts, billing, claims, or Got2Ship services should be submitted through the current contact information published on the Got2Ship website.

Acceptance

BY CREATING A GOT2SHIP ACCOUNT, PURCHASING A SUBSCRIPTION, USING A GOT2SHIP RECEIVING ADDRESS, SENDING PROPERTY TO GOT2SHIP, OR REQUESTING GOT2SHIP SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO THESE TERMS OF SERVICE.

You specifically acknowledge the provisions concerning:

  • Account sharing;

  • Customs responsibility;

  • Claims deadlines;

  • Billing and chargebacks;

  • The 45-day abandoned-property process;

  • Got2Ship's lien rights;

  • The $200 maximum liability;

  • Carrier liability;

  • Claims and settlements; and

  • Arbitration and dispute resolution.
